Introduction to the Executive Bylaws of the Franchise System
The Executive Bylaws of the Franchise System in the Kingdom of Saudi Arabia were issued by the Ministry of Commerce under a ministerial decision dated 18/9/1441 AH, corresponding to 11/5/2020 AD. These bylaws are applied to all contracts and agreements governed by the Saudi Franchise System.
The aim of these bylaws is to regulate the contractual relationship, provide legal protection for the franchisor and the franchisee, and ensure the fulfillment of necessary licensing, registration, and investment requirements in the Kingdom.
The bylaws include several provisions and requirements that parties must adhere to, including:
- - Conditions for granting the trademark.
- - Disclosure document requirements.
- - Franchise agreements and their types.
- - Registration conditions.
- - Licensing for the use of the trademark.
The bylaws seek to create a suitable business environment for the growth of the franchise sector in the Kingdom and achieve the goals of Saudi Vision 2030 to enhance investment and develop the economy.
